I sort of question how this works in practice. Every Senator will be under irresistible pressure to say how they voted. If they tell the truth, it’s no different from a public ballot. Long worthwhile thread. I’m reminded of a point that (I think?) Foucault makes in Surveiller et Punir that, historically, the aristocracy was ostentatiously visible & the common person visible, but modernity has inverted this. The irony of course is that Originalism’s big selling point was supposed to be constraining the discretion or judges to impose their own political preferences as law.
