@Teri_Kanefield So, prosecutors, judges, clerks, etc might be ‘fair game’ so to speak, but what if TFG decides to make derogatory comments about Jack Smith’s family (wife, children etc) or witnesses. Can a gag order apply to statements about those people?

@Teri_Kanefield Before even reading your explainer, I can tell you will do all the research necessary to give us a detailed report. As for me, I have always believed the Framers and later on the Writers of Amendments to the Constitution made it sufficiently vague to leave leeway to interpretation. That’s no surprise as the Framers meant for the Constitution to be a ‘living document.’ The verbiage in Section 3 of the 14th Amendment are a prime example of ‘sufficiently vague’.

@Teri_Kanefield I am not a lawyer, but your Blog echoes my sentiments exactly. There is NO easy answer to Section 3 of the 14 A. In fact, there may be no answer at all. I’ve pondered over what it is I would LIKE to happen but I just don’t know. What’s fair (even for TFG), what’s bias???? I’m not a fan of SCOTUS right now, but I don’t envy their task on this issue. It’s not the “slam dunk” Habba wants us all to believe. Thank you for your insightful thoughts.

@Teri_Kanefield Just read your weekend post. I have to say, your connection between fiction and litigation writing is spot on. I wish I had made those connections to students when I was teaching middle school. Also, I like the simple comparisons you make in order to help everyone understand a legal concept.
