The humans were merely negligent, but negligence isn't the standard under the CFAA and Congress has intentionally protected the tech industry from any criminal or civil liability for decades. And the AI agents lack intent because they lack the capacity for it. We need Congress and other government jurisdictions to impose criminal and civil liability for negligence on the builders, hosters, and operators of autonomous agents.
