If the democrats take the senate back it would be rather funny to see an appointment locked out “until the people can have a say”

The problem is if Alito retires between the election and Republican senators being replaced on January 3, the Senate would rush to confirm his replacement to prevent the potential blocking of Trump’s nominated candidate.
