began honing an argument this morning that the essence of commerce is liability. it goes like this: you're not paying for "unique selling points" or "special service". these are traits by which the seller defines their own worth. you're paying for liability. liability begins with the product being delivered or the service being rendered and ends with the product/service lasting a reasonably long time, being well supported while harming no one, or the company making up for its mistakes.

  • in short, if what you're giving me is not free or open, and/or you expect compensation for it, then i expect liability. of course this is not a pleasant thing to think about for sellers. for some it doesn't seem to cross their mind at all, and others try to lobby for an ever diminishing liability, but doing this, and that is what i'm getting at, devalues commerce. the whole point of commerce is liability. if you're not liable, then i'm not buying.
